Eu Albania Readmission Agreement
2. Albania shall allow the transit of third-country nationals or stateless persons when requested by a Member State, and a Member State shall allow the transit of third-country nationals or stateless persons when Albania so requests, when transit to any other States of transit and readmission by the State of destination are ensured. The provisions of this Agreement shall prevail over the provisions of bilateral agreements or agreements on the readmission of persons staying without authorisation which have been or may be concluded between each Member State and Albania in accordance with Article 19. Relationship with bilateral readmission agreements or agreements concluded by the Member States 3. The readmission obligation referred to in paragraph 1 shall apply to the Member State which issued a visa or residence permit. Where two or more Member States have issued a visa or residence permit, the readmission obligation provided for in paragraph 1 shall apply to the Member State which issued the document of a longer period of validity or, if one or more of them have already expired, the valid document. Where all documents have expired, the readmission obligation referred to in paragraph 1 shall apply to the Member State which issued the document on the most recent expiry date. Where such documents cannot be provided, the readmission obligation referred to in paragraph 1 shall apply to the Member State of last exit. 2.
The implementing Protocols referred to in paragraph 1 shall enter into force only after they have been informed of the Readmission Committee referred to in Article 18. 4. Albania or a Member State may withdraw any authorisation granted if, subsequently, circumstances referred to in paragraph 3 arise or if it is revealed that they impede transit or if the continuation of the journey to possible States of transit or readmission by the State of destination is no longer ensured. In that case, the requesting State shall immediately withdraw, if necessary, the third-country national or stateless person. 2. If necessary, Albania shall without delay issue to the person whose readmission has been accepted the travel document necessary for his return, valid for at least six months. If, for legal or real reasons, the person concerned cannot be transferred during the period of validity of the travel document initially issued, Albania shall extend the validity of the travel document within fourteen calendar days or, if necessary, issue a new travel document with the same period of validity. If Albania has not issued the travel document within fourteen calendar days, if it has not renewed its validity or, if necessary, if necessary, accepts the use of the standard EU travel document for expulsion purposes . . . .
